     Carrying a loaded rifle in an automobile :confused:

Q: If a person has a carry permit can they carry a rifle or shotgun loaded in their truck?

A: Let's start by discussing the legal methods of carrying a firearm in a motor vehicle and come back to the permit to carry part of it. Minnesota Statute 97B.045 says that in order to transport a firearm in a motor vehicle it must be: unloaded and cased, unloaded and in the closed trunk of the motor vehicle, or a handgun carried in compliance with M.S. 624.17 which is the statute laying out the provisions requiring a permit to carry a pistol.

Subdivision 3 of the same statute allows for the carrying of an uncased and unloaded firearm in a motor vehicle (excluding pistols) if the person is at a shooting range, travelling to or from a place where they lawfully hunted, or while lawfully hunting. Uncased firearms are not permitted when in a statutory city with a population greater than 2,500, in Anoka/Hennepin/Ramsey counties, or on school grounds.

Notice that all provisions of this statute say the firearm must be unloaded but specifically state exceptions related to handguns. The mention of handgun or pistol in this statute is intended for permit to carry holders. Permit to carry holders may carry a loaded pistol/handgun in a motor vehicle, but if it were any other type of firearm it would be a violation of M.S. 97A.045.
