Title: hey .any advise. on a very serious topic

my daughter came home from duluth, recently broke up with her live in boyfreind and his two kids. while home he wiped the 3 bedroom apt. clean out. took everything. cops say its a civil matter. anyone no a good lawyer in duluth. she filing in court. and calling social serices in bemidji wher he is from. also she gotting ahold of a nasty wemons advoc group to help her. shes been completly strip of her life and identiy ecept her drivers lisence. she at a motel right now. any advice would be great

If he stole her identity stuff, it's NOT just a civil matter, it's a criminal complaint. If it's just possessions, it is a civil matter. File a police report...regardless. Report to Social Services..Womens Shelter group, document all with the PD. Small claims court will be needed to get her stuff back. Not much a lawyer can do, or will do on this one. Tell her to save her money and do all of the above. Seen that a lot in my career as a cop, Boar...trust me on this one. Good luck, keep us advised.

no identitie stolen just feels like it. but he did take guns in her name whiche shes filing and vehicle titles my wife is help with social services their both mandated reporters. shes fine but just so.violated and rip open.

yeah well i aint laughing to much here. nobody fks with kids. and the sucky thi g is 20 years ago i  woulda intorducex to my sock and a cue ball. but i cant, an got sit watch my baby girl go thru this and thers nuthing th dumbass cops will do cause its civil. and what that means it aint important enough. so  someone can live with someone then just rob them blind and let the courts decidem howe screwd up is that!!!!

If he stole guns and such, how the heck can they say it's civil???! Did they talk to HIM already? They need to talk to BOTH, ALWAYS  before they make any assumption like that. They need to at LEAST talk to him, to determine if it is civil...they CAN do that, Boar!!! When they go out on a call, they don't know if it's a civil situation or not....same thing here. I'd call and demand they go talk to the guy! I feel for ya, man, and for her. Wish I could do something. Guess if that don't work, go find the guy...and do what ya need to do. Tell the cops to stay outta it, cause it's a civil matter.

Well, someones's fulla crap, because taking someone elses personal belongings, is LARCENY, which is a CRIME.



Definition of Larceny


Larceny is what most people think of as common theft - the taking of someone else's property without the use of force. The Model Penal Code and the laws of states place larceny and certain other property crimes under the general category of theft. However, there are some states that retain the traditional common-law distinctions in which larceny is its own crime, separate from other property crimes like embezzlement or robbery.

The Elements of Larceny

The following elements must be proven in order to obtain a conviction for larceny:

The unlawful taking and carrying away;
Of someone else's property;
Without the consent of the owner; and
With the intent to permanently deprive the owner of the property.


Unlawful taking:

The first stage in a larceny involves the unlawful taking of another's property. So the removal or appropriation of property for a lawful purpose is not larceny, such as when a bank repossesses a car for non-payment.

Some states also require that the taker carry the property away. For immovable property, carrying away can be satisfied where the perpetrator has taken control of the property and removed its use and enjoyment from the owner.

Someone Else's Property

For larceny to apply, the property in question must belong to someone else. If it belongs to the person taking it, then larceny would not apply. This is true even if one's property was in the possession of another at the time it was taken. For example, it's not larceny when someone takes back a lawnmower lent to a neighbor who failed to return it. In these situations, the only thing that matters is whether the person in control of the property had a better legal claim to the property than the person who took it.

People who co-own property can also commit larceny if they deprive any co-owners of their right to the property. So, if three friends jointly purchase a computer and one of the friends moves away with the computer without the consent of the other friends, this would constitute larceny.

Without the Owner's Consent

Even if someone intends to steal a piece of property, no larceny occurs if the owner consents to the transfer of ownership of the property. However, it would be a crime if the owner transferred the property due to another person's deceit or fraud, although these situations are covered by other property crimes.

The Taker's Intent

The final element of larceny involves the taker's intent to permanently deprive the owner of the use and enjoyment of the property. In other words, if the person who took the property intended to eventually give it back, this would not constitute larceny.

Larceny is a specific intent crime, which means that the person taking the property must specifically intend to commit larceny. So in a situation where a person reasonably believes that they own the property they are taking, they would not have the specific intent of required for larceny.

I'm behind ya 100%, Boar. Now, my other advice: Go to the Captain of the dept, and start there...rattle his f**n cage good. Don't take some pissant patrolman's explanation. That's EXACTLY what I would do...trust me! I just rattled some cops cage last nite in relation to some pissant idiot neighbor...and it got taken care of. I like to always start at the top and work my way down, as I'm fond of saying.

shes doing a little better. getting her ducks in a row, deposites..recepcs.ect ect. he had help.and all.3 people.were serverd with a court sumons for july 20th.  this is how stupid he is. he text her askig if i could haul.her stuf out his garage. she said no, cause she wants to take him down. he said well if yu dont work with me on thiz ill have to charge u storage.fees for ur stuff. eith really dumb or just messi g wifh her.
