Have a friend that was bowhunting with two other friends on state land. He had a game warden come up to him about 4;30, first thing the game warden said was can I see your cell phone please? He gave it to him. He checked if they had been texting each other about deerhunting . They had not, but could have got a fine if they had. just a heads up. Just a question if a game warden asked for your phone, would you have to give it to him? I would becouse I dont text when hunting, but  do you?

Ive texted my fellow hunters while in the woods, mostly for safety reasons and to inform the rest of the party that we got a deer.  Because I think it would be alot worse if our party was to shoot an extra deer, because we didnt know how many tags were filled.   :scratch:

Is it illegal?!  Maybe, but I think if you arent saying, "There is a big deer headed your way from the left, keep an eye out."

There is an article in the latest Outdoor News regarding this topic.  Information from the Game Warden is included.  They do mention asking for a cell phone.  Also, the warden gives his opinion on the subject.

this is because your not allowed to use electronic devices to "take" game. so yes saying i fell from my stand and need help is ok. saying im coming your way so be ready is not. there is obviously going to be a lot of grey here as well. for instance saying im going in to camp could be an offense, depends on the context its in and the conservation officer. as far as giving a cell phone, same for anything else if he asks and you say yes, thats permission. now if you say no, thats gonna give him some suspicion to further investigate and he/she will probably end up with it anyways. your call, dont do anything illegal and you got no problems!

When I used to hunt public I would see guys useing talkies all the time. As far as the cell phones, all you would have to do is delete the texts.

I am old school,, I do not text, I all so just turn my phone off while hunting!!  As the last thing I want is the phone to ring at the same time I putting my cross hair on a buck!!

But for those that do text while hunting and think your just going to delete it to not get caught think again, You may think you delete it but in fact it stay on your phone. Just like your hard drive on your computer.

If you do not brake the law you have nothing to worry about!!
Yes I would just hand him my phone!! he will look and then he be on his way as then I could get back to my hunt!!

If they want to walk up on you on state land they can at any time.

As the more  :censored: you give them the longer you will not be hunting..

It come down to a few that brake the law and we all pay for it!!

I would guess this isnt worth there time even if it still in your phone after you delete them. To confinscate your phone and to have it sent in to be pulled out of the memory and then go threw all texts messages just aint going to be worth the time and resorces it they would need to bring you up on changes

But even if your deleted text messages are off your carrier's server, they may not be gone forever. When you press the delete button on your phone, the data that make up your message don't disappear in an instant. Instead, the code is marked with a sort of tombstone that indicates which data can be overwritten. But until enough new information is added to fill that memory, your old text message will remain on your device. If you used a SIM card to store your text messages before you erased them, then there might be space for the remains of 30 or so deleted messages; if the messages are downloaded directly to your phone, several hundred deleted messages could stick around on your device. Eventually, of course, the deleted messages will disappear as memory is filled with new messages, photos, or videos.

Still, it isn't always easy to recover a deleted message before it's overwritten. First, you have to find a way to get the code off the cell phone. Then, you need to translate that code back into the human language of the original text message. If your messages are stored on a SIM card, you can purchase a device for as little as $150 that allows you to recover erased data on your own.

Now I would say It will not be long before the DNR will have device to check your last 24 hours on your phone,

He is wrong.  They do stay on the phone until overwritten.  That can take some time.  I have used a sim card reader to get deleted messages off of phones before.

no there not on the phone but yes they can be looked up using the SIM card (which is in the phone)

Yes this may to true But if you tell a DNR that you are not going to give your phone to him!! I bet they will take the time to go throw your phone. That like tell them no you can't not look in my truck, They will take the time to go throw everything, That their job.

i think the point is the basis for the search.. they can walk up and ask you for your phone and if you give it to them your "consenting" to the search. they have no probably cause to "seize" your phone. just like if a cop asks you how fast you were going. you admit to speeding he can give you a ticket. you say you were going the speed limit they have to prove you were speeding. there is no CSI lab for dnr officers to retreive your messages especially from just a random check. now in a case of poaching with someone turning you in.. ya I'm sure BCA will step in and help them. not likely in the random case of random hunters on random chunks land. this is more about lazy CO's than anything.
