got a question. I have a pine tree close to the property border. some of the branches hang over the line into the neighbors side. mind you these branches are in the air.

is it legal for him to cut branches off MY TREE???????? PRETTY OBVIOUS  as the branches cut follows along with the property line.

YES, it IS. Been there, done that, with my old dickhead neighbor. ....with my attorney, just so ya know. He was served notice, etc, it turned into a big legal battle, as he refused to trim his tree. Law states ANY part of a tree, shrub, bush, flower, or plant that hangs over or encroaches on a neighbor's property can be trimmed/cut/removed to the property line....but THEY (person cutting) has to haul it away. Sooo.....he can hack away at yer tree all he wants, right up to the property line... :doah:

ok ok........but the least he could of done was ask. he is such a total a..hole. lets just say if his house starts on fire I wouldn't throw gas on it...........but then again I wouldn't throw water on it either.

actually as much as I dispise this guy I would of said yea, I kinda in the back of my mind new he could do this. its past history, this guy does things when we aren't around. besides not worth getting into a pizzing match. I got more important things to worry about.

the neighborly thing would be to ask or say something. besides a got laugh at him, he's planted more trees in his yard and cant keep them alive!!!!!!! :rotflmao: :rotflmao: :rotflmao: :rotflmao: :rotflmao: :rotflmao: :rotflmao: :rotflmao:

Here is another angle to the tree line debate.  So what if someones tree is leaning toward your house in a precarious position and looks as it will fall on your house during a storm.  It is his tree so is he responsible to protect your house by having the tree removed or at least the part putting your house in danger?  If the tree does fall on your house who's insurance will cover it?

nope wouldn't mess with someone elses stuff. but I do think he killed 2-3 young pines we tried planting. the spot is now new grass!!!!!!!!!!!!!!! its pretty tough to kill pine trees!!!!!

I understand, but the tree is in a harmless spot. it wont affect anything he has. the only thing is when the pine cones fall.....and its a lot..............but I clean them up even in his yard. he's just a plain DOUCHEBAG!!!!!!!!

That's the prob I had. Neighbors huge tree hanging over my yard. He's not obligated to trim it, but I can. If it falls on my house, MY insurance covers it. My deductible? If he refuses to pay it, I have to take him to small claims court to collect and be able to prove tree was a hazard.
That's it in a nutshell.
