Chippewa to fish early in treaty clash
The dispute
The Leech Lake Chippewa Tribal Council said on Thursday that it has not authorized a threatened fishing protest by band members on May 14, a day before the opening of the state's walleye and northern pike seasons, and urged protesters to stay home.

"The band's legal department jumped the gun" in saying the protest would be held, said Mike Bongo, one of five Leech Lake Tribal Council members. "The band always seeks to use diplomacy first."

On Wednesday, Leech Lake band tribal attorney Frank Bibeau and band 1855 treaty coordinator Dale Greene said the protest would be held to assert treaty rights that the band, together with the White Earth Chippewa band, believes it reserved under treaties signed with the federal government in 1854 and 1855.

"The Council understands the desire of the Leech Lake people to exercise hunting, fishing and gathering rights under the 1855," tribal chairman Arthur LaRose said in a statement. "However, we need to sit at the table with the state and do our best to resolve the issues presented by the 1855 treaty in a diplomatic process."

Bongo and others worried about the reaction such a protest could provoke. "This has the potential to set back community relations for us many, many years, something we're not interested in doing," Bongo said.

White Earth band representatives couldn't be reached for comment Thursday.

On Wednesday, DNR Commissioner Mark Holsten said no one from the bands had spoken to him or anyone in the Pawlenty administration about treaty rights or a protest.

Bongo said on Thursday that his band will try to meet with Holsten as early as next week. "We welcome the opportunity to sit down with the commissioner and the governor, if he's available, to see what we can find in terms of middle ground," Bongo said.

I grew up in Cass Lake and my high school classes in the 1960s were 50-50 white and Indian. As kids growing up we were friends, played sports together, wild riced together, hunted together, and worked together all with out any problems.
Now if they persisted in protesting their rights by fishing 1 day before our season I was going to request my senator and legislator work to stop the multi million-dollar yearly pay out to the tribe not to hunt and fish off the reservation.
In addition I have spent way over 10 thousand in entertainment dollars at three different casinos in 2009. So I was going to send a letter of protest to the three casinos stating I was going to stop going to their casinos if they fished before our season. I was going to try my best to encourage every one within shouting distance to do the same.

from the sounds of it, they arent even using fishing poles they will be using nets. this has got to stop, i have read and read about this and kind of kept to myself about it, but now there starting to get power hungry and prove that they can literally do anything they want and have little to no conseqeunces(sp) for it. it states in the the paper that even if the DNR does right tickets that they will have to have them dismissed with no action taken. you know what im tired of them stating that theres this treaty and that treaty but enough of the dang treatys what happens when you lose a war? you lose land and yes they faught(sp) and lost the war so what we did to make everything better we give them some land. but now its been gradually getting worse. if the goverment lets them get away with it if they do it then it wont stop. did you know they can kill the national bird and have no consquences for it if its for ceremonial purposes? how can the goverment talk about equality when we have ppl right here in this state that are literally higher than any law we have, you cant have a nation inside a nation and expect everyone to get along. the only way we can come together as a nation is to have everyone under the same law and order.

i like the comment about how 3 or more indians off the res constitute a war party... So legally you can kick their ass back to the res... cause the treaty says so.  Live by the treaty, get your ass kicked by the treaty.

I stopped going to their casinos a loooong time ago. I worked in the Hinckley casino for 4 years and saw only a handful of people that were ahead of the games. Those were the "pro's". You ARE going to lose.

I will have to read the Treaty in its entirety but am quite sure 2 or more is a war party and can be shot on sight if off the reservation. But of course they don't think like that part because they say its unfair and can't profit from it.
